A.    Conditions of Sale (Between Sellers and Customers)

This online platform can be utilized by users to reach a larger base to buy and sell products or services from a listed price at any time and from any location using a payment method of your choice. The actual contract for the sale of any of the products or services is strictly between the seller and the buyer. Umara's Mart is not a party to the transaction, and it is not a seller or a traditional auctioneer. We do not transfer legal ownership of items from the seller to you. We are only providing a platform for communication and we are not responsible for any non-performance or breach of any contract entered into between buyers and sellers. We accept no liability for any errors or omissions, inaccuracy, or incompleteness of any information or specifications of products whether on behalf of itself or third parties. We will not be a party to mediate or resolve any dispute or disagreement or in any way be responsible for monitoring any transaction between you and the sellers. We recommend you use your best and prudent judgment for any transactions entered into through the site or services. These Terms govern your purchase of products via the platform and by purchasing products from the platform; you shall agree to comply with our conditions relating to the buying of products or services on the site.

Selling

From time to time, a seller shall agree to comply with our conditions relating to the sale of products or services on the site. A registered seller is allowed to list items for sale and shall agree to comply with our Seller Policy.

Buying

Please read these terms carefully before committing to buy or placing an order for any product or service via the platform. A registered buyer is allowed to purchase from listed items and shall agree to comply with the following buying practices

i.          The display of products or services on our website constitutes an invitation to treat and by completing our online order (including your payment details), you are making a legal offer to the seller to purchase the relevant goods or services at the prices stated at the time of ordering;

ii.          All discounts, and offers are made by the Seller. Your participation in all such events on or through the platform is solely between you and the seller;

iii.         Our acceptance of your order brings into existence a legally binding contract between us. If your order has not been accepted, you will receive an email from us to notify you of the rejection cause. You can track your order from the order id

iv.         The confirmation email shall include details of the ordered products, payment method, and cost. You must ensure that your email address is up to date in the database. Please contact us as soon as possible if any details are incorrect. We will deliver the goods to the address that you have provided on the checkout page;

v.         You will become the legal owner of the goods you have ordered when payment for the goods has been done and when they have been delivered to you. You can choose your payment method available on our site. Cash on Delivery is also available. The goods will be held at your own risk from delivery. We will not be liable for their loss, damage, or destruction after they have been delivered to you;

Canceling Order

i.          if we fail to verify your identity

When placing an order, you warrant that all details you provide to us for the purpose of the order are true, accurate, current, and complete in all respects; you warrant that the credit or debit card you are using is your own and there are sufficient funds in your account to cover payment of the product(s) ordered other than cash in delivery. We also reserve the right to validate your identity and payment details in order to prevent credit/debit card fraud. The absence of an answer to relevant inquiries may automatically cause the cancellation of the order within a reasonable timeline.

ii.          if we suspect a risk of fraud

We also proceed to direct cancellation of an order for which we suspect a risk of fraudulent use of banking instruments or other reasons without prior notice.

iii.         if the product is mispriced, defective, malfunctioned, or expired

Product pricing is subject to change at any time without notice. Despite our conscientious efforts, a small number of items on the site may be mispriced or described inaccurately. We reserve the right to withdraw malfunctioned or expired products and give you the option of reconfirming your order or canceling. If such a cancellation occurs on your prepaid order, our policies for refund will apply. Please see our Return & Refund Policy.

Besides that, this price may also vary when you place an item in your cart before or after any promotion. But items in your shopping cart will always reflect the most recent price.

iv.         Returns & Refund Policy

We will work to ensure your satisfaction with your purchase of any item from Umara's Mart platform and proudly offer a risk-free money-back guarantee. We quality-check each item individually before they are dispatched to our customers. However, we understand that sometimes an item may not be what you expected it to be. In that unlikely event, you are welcome to return it for a refund within 3 days of receipt, subject to our Return & Refund policy given in a later section.

INTELLECTUAL PROPERTY RIGHT

Umara's Mart and licensors/merchants own and are in control of all intellectual property and material whether registered or unregistered displayed on our site including, but not limited to website design, content, features, functionality, images, audio, videos, text, graphics, logo, software compilations, and source code. We don't allow any illegal infringe by performing, displaying, distributing, republishing, reproducing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to us or someone else. Any unauthorized use of the materials appearing on the site without prior written permission from us may violate trade dress, patent and trademark laws, unfair competition laws, and related proprietary rights. These could also result in criminal or civil penalties.

8. GOVERNING LAW, JURISDICTIONAL ISSUE & COMPLAINTS

The site is controlled and operated by Umara's Mart. You are responsible for complying with e-commerce rules and all local laws of Bangladesh. If a complaint arises between you and us, we strive to resolve the dispute fairly, quickly, and efficiently. ক্রয়

প্ল্যাটফর্মের মাধ্যমে কোনো পণ্য বা পরিষেবা কেনার বা অর্ডার দেওয়ার আগে অনুগ্রহ করে এই শর্তাবলী সাবধানে পড়ন।

একজন নিবন্ধিত ক্রেতাকে তালিকাভুক্ত আইটেমগুলি থেকে ক্রয় করার অনুমতি দেওয়া হয় এবং নিম্নলিখিত ক্রয় পদ্ধতিগুলি মেনে চলতে সম্মত হবে৷

খ) আমাদের ওয়েবসাইটে পণ্য বা পরিষেবাগুলির প্রদর্শন চিকিত্সার জন্য একটি আমন্ত্রণ গঠন করে এবং আমাদের অনলাইন অর্ডার (আপনার অর্থপ্রদানের বিশদ সহ) সম্পূর্ণ করার মাধ্যমে আপনি বিক্রেতাকে সেই সময়ে বর্ণিত মূল্যে প্রাসঙ্গিক পণ্য বা পরিষেবাগুলি কেনার জন্য একটি আইনি প্রস্তাব দিচ্ছেন। আদেশের;

গ) সমস্ত ডিসকাউন্ট, এবং অফার বিক্রেতা দ্বারা তৈরি করা হয়. প্ল্যাটফর্মে বা এর মাধ্যমে এই ধরনের সমস্ত ইভেন্টে আপনার অংশগ্রহণ শুধুমাত্র আপনার এবং বিক্রেতার মধ্যে;

ঘ) আপনার আদেশের আমাদের গ্রহণযোগ্যতা আমাদের মধ্যে একটি আইনত বাধ্যতামূলক চুক্তির অস্তিত্ব নিয়ে আসে। আপনার অর্ডার গৃহীত না হলে, আপনি প্রত্যাখ্যানের কারণ সম্পর্কে আপনাকে অবহিত করার জন্য আমাদের কাছ থেকে একটি ইমেল পাবেন। আপনি অর্ডার আইডি থেকে আপনার অর্ডার ট্র্যাক করতে পারেন;

ঙ) নিশ্চিতকরণ ইমেল অর্ডার করা পণ্যের বিবরণ, অর্থপ্রদানের পদ্ধতি এবং খরচ অন্তর্ভুক্ত করবে। আপনাকে নিশ্চিত করতে হবে যে আপনার ইমেল ঠিকানা ডাটাবেসে আপ টু ডেট আছে। কোনো বিবরণ ভুল হলে যত তাড়াতাড়ি সম্ভব আমাদের সাথে যোগাযোগ করুন, আমরা চেকআউট পৃষ্ঠায় আপনার দেওয়া ঠিকানায় পণ্য সরবরাহ করব;

চ) পণ্যের জন্য অর্থ প্রদানের সময় এবং যখন সেগুলি আপনার কাছে পৌঁছে দেওয়া হবে তখন আপনি যে পণ্যের অর্ডার দিয়েছেন তার আইনি মালিক হয়ে যাবেন। আপনি আমাদের সাইটে উপলব্ধ আপনার পেমেন্ট পদ্ধতি চয়ন করতে পারেন. ক্যাশ অন ডেলিভারিও পাওয়া যায়। পণ্য ডেলিভারি থেকে আপনার নিজের ঝুঁকিতে রাখা হবে. আপনার কাছে পৌঁছে দেওয়ার পরে তাদের ক্ষতি, ক্ষতি বা ধ্বংসের জন্য আমরা দায়ী থাকব না;

অর্ডার বাতিল করা

ক) যদি আমরা আপনার পরিচয় যাচাই করতে ব্যর্থ হই অর্ডার দেওয়ার সময়, আপনি ওয়ারেন্টি দেন যে অর্ডারের উদ্দেশ্যে আপনি আমাদের যে সমস্ত বিবরণ প্রদান করেন তা সত্য, নির্ভুল, বর্তমান এবং সমস্ত ক্ষেত্রে সম্পূর্ণ; আপনি ওয়ারেন্টি দেন যে আপনি যে ক্রেডিট বা ডেবিট কার্ডটি ব্যবহার করছেন তা আপনার নিজস্ব এবং নগদ ইন ডেলিভারি ব্যতীত অর্ডার করা পণ্য (গুলি) এর অর্থ প্রদানের জন্য আপনার অ্যাকাউন্টে পর্যাপ্ত তহবিল রয়েছে। ক্রেডিট/ডেবিট কার্ড জালিয়াতি প্রতিরোধ করার জন্য আমরা আপনার পরিচয় এবং অর্থপ্রদানের বিশদ যাচাই করার অধিকারও সংরক্ষণ করি। প্রাসঙ্গিক অনুসন্ধানের উত্তরের অনুপস্থিতি স্বয়ংক্রিয়ভাবে একটি যুক্তিসঙ্গত সময়রেখার মধ্যে অর্ডার বাতিলের কারণ হতে পারে।

খ) যদি আমরা জালিয়াতির ঝুঁকি সন্দেহ করি আমরা এমন একটি অর্ডার সরাসরি বাতিল করার দিকেও এগিয়ে যাই যার জন্য আমরা পূর্ব নোটিশ ছাড়াই ব্যাঙ্কিং যন্ত্রের প্রতারণামূলক ব্যবহারের ঝুঁকি বা অন্যান্য কারণে সন্দেহ করি।

গ) যদি পণ্যটির মূল্য ভুল, ত্রুটিপূর্ণ, ত্রুটিপূর্ণ বা মেয়াদোত্তীর্ণ হয় পণ্য মূল্য নোটিশ ছাড়াই যে কোনো সময় পরিবর্তন সাপেক্ষে, আমাদের আন্তরিক প্রচেষ্টা সত্ত্বেও, সাইটে অল্প সংখ্যক আইটেমের মূল্য ভুল বা ভুলভাবে বর্ণনা করা হতে পারে। আমরা ত্রুটিপূর্ণ বা মেয়াদোত্তীর্ণ পণ্য প্রত্যাহার করার অধিকার সংরক্ষণ করি এবং আপনাকে আপনার অর্ডার পুনরায় নিশ্চিত করার বা বাতিল করার বিকল্প দিই। আপনার প্রিপেইড অর্ডারে এই ধরনের বাতিলকরণ ঘটলে, আমাদের অর্থ ফেরতের নীতি প্রযোজ্য হবে। অনুগ্রহ করে আমাদের রিটার্ন এবং রিফান্ড নীতি দেখুন। এছাড়াও, আপনি যখন কোনো প্রচারের আগে বা পরে আপনার কার্টে একটি আইটেম রাখেন তখন এই মূল্যটিও পরিবর্তিত হতে পারে। কিন্তু আপনার শপিং কার্টে থাকা আইটেমগুলি সর্বদা সাম্প্রতিক মূল্য প্রতিফলিত করবে।

Umara's Mart এবং লাইসেন্সদাতা/ব্যবসায়ীরা আমাদের সাইটে নিবন্ধিত বা অনিবন্ধিত সমস্ত বৌদ্ধিক সম্পত্তি এবং উপাদানের মালিক এবং নিয়ন্ত্রণে রয়েছে যা ওয়েবসাইট ডিজাইন, বিষয়বস্তু, বৈশিষ্ট্য, কার্যকারিতা, ছবি, অডিও, ভিডিও, পাঠ্য, গ্রাফিক্স, সহ কিন্তু সীমাবদ্ধ নয়। লোগো, সফ্টওয়্যার সংকলন, এবং উত্স কোড। আমরা সম্পাদন, প্রদর্শন, বিতরণ, পুনঃপ্রকাশ, পুনরুত্পাদন, অনুলিপি, বিপরীত প্রকৌশল, ডিকম্পাইলিং, বিচ্ছিন্নকরণ, বা আমাদের বা অন্য কারোর বিষয়বস্তু থেকে ডেরিভেটিভ কাজ প্রস্তুত করে কোনো অবৈধ লঙ্ঘনের অনুমতি দিই না। আমাদের কাছ থেকে পূর্ব লিখিত অনুমতি ব্যতীত সাইটে উপস্থিত সামগ্রীগুলির যে কোনও অননুমোদিত ব্যবহার ট্রেড ড্রেস, পেটেন্ট এবং ট্রেডমার্ক আইন, অন্যায্য প্রতিযোগিতা আইন এবং সম্পর্কিত মালিকানা অধিকার লঙ্ঘন করতে পারে। এর ফলে ফৌজদারি বা দেওয়ানি দণ্ডও হতে পারে।
